However, most of the aspects addressed in the guidance have already been discussed in previous videos and blog articles where I have informed industry members that, unfortunately, if you manufacture any firearm or firearm part, you are required to register under ITAR. There is one exception to this rule - shotguns with a barrel length over 18 inches and an overall length over 26 inches, which have a sporting purpose. Manufacturers of such shotguns do not need to register. Even if you manufacture just a barrel that doesn't require a Federal Firearms License (FFL), you still must register with DDTC. However, the issue with registering is the cost - $2,250 per year, not including any export permits. For years, many people argued that they didn't need to register because they weren't exporting, they were just manufacturers. I have written several blog articles debunking this belief, stating that under the Arms Export Control Act and ITAR, registration is required.
